VERDICTS

  • Tracy Reed-Brown v. Rex Medical L.P., Cause No. 00241 (Philadelphia Court of Common Pleas).

    • Verdict: $33,684,140. This case involved product liability claims for defective design involving an IVC Filter device. The case produced the first verdict for plaintiff in a case against the Rex Medical involving an IVC filter.

  • Jeffrey Pavlock v. Cook Inc., et al., Cause No. 2017-03885 (Harris County, Texas).

    • Verdict: $1,240,500. This case involved product liability claims for defective design and inadequate warnings involving  an IVC Filter device. The case produced the first verdict for plaintiff in a case against the Cook Entities involving an IVC filter.

  • Perry v. Ethicon, et al, Cause No. S-1500-CV-279123 (Kern County, California).

    • Verdict: $5,700,000 verdict for Plaintiff. This case involved product liability claims for defective design and inadequate warnings relating to a pelvic mesh device. It was the first trial involving Defendant’s TVT-Abbrevo medical device and produced the first plaintiff’s verdict in a TVT-Abbrevo case.

  • Salazar v. Boston Scientific, Corp. et al., Cause No. DC-12-14349 (Dallas County, Texas).

    • Verdict:  $73,465,000 verdict for Plaintiff.  The verdict obtained in this case has the distinction of being the 26th largest verdict in the United States in 2014. This case involved claims for defective design and inadequate warnings relating to a pelvic mesh device.  It produced the first verdict for a plaintiff in a pelvic mesh case against Boston Scientific. 

  • Batiste v. Johnson & Johnson, et al, Cause No. DC-12-14350 (Dallas County, Texas).

    • Verdict:  $ 1,200,000 verdict for Plaintiff. This case involved claims for defective design and inadequate warnings relating to a pelvic mesh device.  This was the first trial, and first plaintiff’s verdict, in a TVT-O case.

  • Anderson v. Janssen Pharmaceuticals Inc., Cause No. 2330 EDA 2014 (Philadelphia County Court of Common Pleas).

    • Verdict:  $3,000,000. This product liability action alleged that the defendant failed to warn plaintiff of the risks of birth defects associated with the prescription drug Topamax.

  • In Re: Coloplast Corp. Pelvic Support Systems Products Liability Litigation: resolution of over 300 cases against medical device manufacturer Coloplast Corporatation involving its pelvic mesh products.
